1. General Rules of Operation Policy
The Online Service Operation Policy (hereafter, “Operation Policy”) contains operational principles as stipulated in the Terms and Conditions of the Online Service for eBaseball™: PRO SPIRIT (hereafter, “this Software”) provided by Konami Digital Entertainment Co., Ltd (hereafter “Konami,” “we,” “us,” or “our”).
Konami will operate Online Services for this Software in accordance with our Online Service Operation Policy. The purpose of the Operation Policy is as follows:
- To resolve problems and situations that may arise during the use of our Online Service
- To take actions to preserve the balance and environment of our Online Service
Konami reserves the right to change the content of our Operation Policy at any time without notice. In such cases, the revised Operation Policy will be posted on the official website immediately and will be effective from the date of posting.
If a customer (hereafter “User”) violates the Operation Policy, we may issue a warning to the User and enforce sanctions in accordance with “Section 6. Sanctions for Violations”.
Users are requested to use our Online Service after familiarizing themselves with the contents of the Operation Policy. In no event shall Konami be liable for any damages incurred by users or third parties in the use of our Online Service, except in cases where exemption from liability is not permitted by law.
2. About Our Operation Management
Konami will assign a Game Master (hereafter, “GM”) within the Online Service.
We will provide support for Online Services in order to provide a smooth experience for Users.
We will be responsible for resolving any problems that arise while using Online Services, and for monitoring Users who engage in harassing behavior or cheating.
We have authority over the overall operation of Online Services, including issues related to the monitoring of Users, sanctions against Users, decisions related to events within the Service, and information management.
We will provide support for Online Services in order to constantly provide a comfortable playing environment for all Users.
We will strive to respond to any questions, comments, or requests from Users who require support.
However, we will not respond to requests that do not have a valid reason, requests that may inconvenience other Users, or requests for information that provide an unfair playing advantage.
We will collect/review User questions, opinions, and requests periodically to create data that aids in the future improvement of this Online Service.
Users must follow any instructions received from Konami while using this Online Service.
Our policy for Users is as follows:
- We will not disclose any User's personal information without the User's consent
- We will never ask for the User's password or other private information within this Online Service
- We will not support or endorse any one specific User or User group
- We will always take a neutral stance and will not engage in any malicious acts against specific Users
- We will not contact Users other than for operational purposes
- We will not make statements about information that has not been officially released
3. User Obligations
Users must not violate the Terms of Use or Operation Policy.
Users who find any bugs or issues while using the Online Service are requested to promptly report them through the inquiry form on the official website.
4. Prohibited Acts
Any conduct deemed by Konami to fall under any of the items below will result in warnings and sanctions.
Please refer to “Section 6. Sanctions for Violations” for a list of specific sanctions.
- Use of inappropriate language in features that let Users input their own text (player name, room comments, my comment, etc.):
- Use of language that includes or implies content that is offensive to public order and morals
- Use of language that includes or implies violence
- Use of language related to sales, advertising, solicitation, election campaigns and other political activities, as well as proselytizing and other religious activities
- Use of abusive, threatening, slanderous, or derogatory language towards the GM, Konami, third parties, or other organizations
- Use of slanderous or discriminatory language against specific nationalities, ethnicities, races, religions, genders, disabilities, or other groups
- Statements that constitute, encourage, or induce criminal acts, or use of language deemed to be associated with criminal acts
- Dissemination of personally identifiable information or information that can be used to identify an individual by referencing multiple statements
- Use of language intended to collect personal information from other individuals
- Use of language deemed to be intended for harmful or vandalistic purposes
- Use of language deemed to be intended to hinder or disrupt the operation of this Online Service
- Use of language that includes the intent to transfer an account or share an account with another User
- Use of language that includes the intent to engage in a real money trade (RMT) to exchange accounts and/or in-game items for real money, physical goods, or information
- Use of language that misrepresents the individual as a GM or Konami employee, or otherwise deceives other individuals
- Use of language that infringes upon the trademark rights, copyrights, or other rights of third parties
- Use of any other language that Konami deems to be highly offensive to other Users
- Use of spelling changes, symbols, synonyms, or homonyms that convey the same meaning as any of the preceding listed items
- Violations of manners when playing online, or conduct that causes significant discomfort to opponent Users
- Fraudulent acts involving false impersonation:
- Falsely impersonating a GM or Konami employee
- Any other conduct performed with the intent to deceive other Users
- Exploiting the game's system:
- Exchanging or sharing accounts with other Users
- Engaging in real money trades (RMT) to exchange accounts for real money, physical goods, or information
- Sharing information with other Users after discovering game bugs or other problems without alerting GMs
- Taking advantage of bugs or other problems to negatively affect this Online Service
- Deliberate manipulation of in-game points (scores, statistics, etc.) that significantly affects the operation of this Online Service
- Any other conduct that interferes with the operation of this Online Service
- Conduct that violates laws and regulations:
- Modification, analysis, or creation and distribution of illegal data of this Software or this Software's programming
- Account creation using a third party's information or other false personal information
- Theft of another User's account
5. Trouble Between Users
Generally, Konami will not intervene in any trouble that arises between users.
Users who find any bugs or issues while using the Online Service are requested to promptly report them through the inquiry form on the official website.
6. Sanctions for Violations
If Users violate or are suspected of violating the Terms of Use or Operation Policy, we will issue a warning and enforce the sanctions listed below against the offending User.
Konami reserves the right to delete User accounts without notice if the User continues to commit violations after a warning has been issued.
- If the offending User holds more than one account, sanctions may be enforced on all accounts that we and the GM deem to be in possession of the offending User.
- A record of warnings and sanctions shall be valid for all accounts that we and the GM deem to be in possession of the offending User, all player characters that exist within the accounts, and all player characters that will be created within the accounts.
- Sanctions may be enforced based on information independent of registered account information.
We will not disclose details of sanctions enforced on individual Users, or respond to questions regarding the sanctions.

Note: In cases of extremely malicious violations, sanctions may be enforced in a manner not in accordance with the above.
7. About Network
Konami is not responsible for the network quality that users have prepared for themselves in order to connect to this Online Service.
Konami cannot accept returns of this Software if the user is unable to connect to Online Services due to an inadequate or insufficient network environment.
Additionally, a network with an open UDP port is required to use the online game matchmaking service.
For details on UDP port opening, please contact your provider or telecommunications manufacturer.
8. Language
Our Privacy Policy has been prepared in, and will be construed in, the Japanese language. Translated versions have been prepared for the convenience of users whose mother language is the relevant translation language; if there is any discrepancy in the meaning or interpretation between the Japanese version and any translated version of this Privacy Policy, the meaning and interpretation of the Privacy Policy prepared in Japanese shall prevail.
