(“Konami,” or “we,” or similar) is a company incorporated in the Netherlands with its headquarters at 14-16 Sheet Street, Windsor, SL4 1BG United Kingdom.  Konami recognizes the importance of the personal information of our customers (“you” or “your” or similar), as well as information which, while not enabling the identification of a particular individual, relates to a person’s device (collectively, “Information”).  Konami handles Information in accordance with the following policy (“Policy”).

This Policy does not apply to any services or products for which we have a separate, individual policy for the handling of Information. Otherwise, by accessing our website and services, you authorize us to collect, store, access, transfer and use your Information as described in this Policy.

Information Collection

Konami may collect the following Information relating to you in the following cases.

  1. When you apply for an ID in connection with usage of Konami services, or when you participate in campaigns, trade fairs, private showings, or other events held by Konami.

    Your name, address or other residence information, telephone number, email address, date of birth, sex, country of residence, country of origin, occupation, language of use, credit card number and other payment information, nickname, questions for verifying a password and corresponding responses, and other information needed for issuing various IDs and accepting applications for participation.
  2. When you purchase or use Konami products or services, or when viewing a Konami website.
    1. Your browsing history as it relates to Konami websites, your internet usage environment, including device identification data, IP address, approximate location data derived from your IP address, and language selection used to browse the websites, history of product and service selection and purchase, and product and service usage.
    2. Konami may collect the following information when you purchase and/or use our games or other products and services through your computer, a game device having a communication function, or a cell phone or other mobile handset.
      OS information and model name as related to the above device or handset; identifier; ID assigned by the other companies, including Apple, Google, DeNA, GREE, Sony Interactive Entertainment, Microsoft, Nintendo, or other company that offers game platforms; game play records, game play results, records of charges assessed; location information obtainable from mobile handsets; information related to viewing of advertisements and publicity, etc.
  3. When you respond to a survey from Konami:

    Items which require responses in survey format, including your name, address or other contact information, and the content of your responses.
  4. When you contact Konami’s customer service desk or customer support desk and Konami responds to your request:

    Information Konami requires in order to respond to your request, including your name, address or other contact information, content of the request, content of the response, and other information needed for subsequent continued response.

Konami may receive your Information from other sources, such as public databases, joint marketing partners, social media platforms (including from people with whom you are friends or otherwise connected) and from other third parties. Our website uses cookies and other technologies for various purposes, including to distinguish you from other users. This helps us to provide you with a good experience when you browse our website and also allows us to improve our website, and display advertisements which are relevant to your interests. Information Use

Konami may use collected Information for the following purposes.

  1. To permit you to use our Digital Entertainment Business products and services and to provide you with related customer service.
  2. To save data to allow continued use of games, let you play against other players, create rankings that reflect game results, and otherwise provide Konami products and services.
  3. For our business purposes, such as data analysis, audits, fraud monitoring and prevention, developing new products, enhancing, improving or modifying our products and services, identifying usage trends, determining the effectiveness of our promotional campaigns and operating and expanding our business activities.
  4. To provide you with information on Konami products and services, including updates to our terms, conditions and policies.
  5. To send you notices of events planned and held by Konami, such as campaigns, exhibitions, and private viewings, to send prizes and giveaways, to operate other events, to provide advertising, publicity, and marketing tailored to your tastes and interests, and to otherwise market Konami products and services to you.
  6. To accept payments for provision of Konami products and services and to fulfill your purchase.
  7. To request opinions and feedback from you on Konami products and services, including through surveys.
  8. To respond to questions and inquiries from you.
  9. To prepare statistical documentation.
  10. To allow you to send messages to a friend through our services.
  11. To facilitate social sharing functionality.
  12. As we believe to be necessary or appropriate, under applicable law, including laws outside your country of residence:(a) to comply with legal process; (b) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (c) to enforce our terms and conditions; (d) to protect our operations or those of any of our affiliates; (e) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (f) to allow us to pursue available remedies or limit the damages that we may sustain.

Information Disclosure

As a rule, we do not provide Information to third parties, except in cases where you have given consent; in cases set forth in this Policy; in cases where the Information is to be disclosed in connection with an organizational restructuring or other disposition of all or any portion of our business, assets or stock, including in connection with any bankruptcy or similar proceedings (in which case your Information will be one of the assets which is transferred between Konami Group companies, as defined below, for the purpose of any such restructuring, or may be disclosed and/or transferred to a prospective or actual purchaser of all or any part of our business); in cases where Konami is required to disclose the Information by law (including laws outside your country of residence); or in cases where disclosure is requested by a judicial, administrative or other government authority (including an authority outside your country of residence).

We may also share Information as we believe necessary or appropriate: (1) to enforce our terms and conditions; (2) to protect our operations, rights, privacy, safety or property and/or that of our affiliates, you or others; and (3) to allow us to pursue available remedies or limit the damages that we may sustain.

Konami shares Information, for the purposes specified in thisPolicy, with members of the Konami Group (i.e., companies in which KONAMI GROUP CORPORATION has a direct or indirect stake, specifically, those listed in [https://www.konami.com/corporate/en/subsidiaries/]). In such cases, Konami Group companies that receive Information will use and manage the Information in accordance with this Policy. Whilst Konami Digital Entertainment B.V. is the data controller of your personal information, KONAMI GROUP CORPORATION is its agent for data sharing (as the ultimate parent of Konami Digital Entertainment BV) and is in charge of sharing of the Information among members of the Konami Group.

Konami may from time to time provide Information we collect from you to service providers with whom we contract to help us to achieve the purposes specified in this Policy. Our service providers may provide, for example, such services as advertising and publicity and data analysis.

You can let us know when you want to stop receiving marketing emails by following the “unsubscribe” link in those emails.

Your Information may be disclosed to your friends associated with your social media account, to other users of the services and to your social media account provider, in connection with your social sharing activity, such as if you connect your social media account to your services account or log-into your services account from your social media account. By connecting your accounts, you authorize us to share information with your social media account provider, and you understand that the use of the information we share will be governed by the social media website’s privacy policy.

Message Boards and Similar Functions

Your Information may be disclosed by you, on message boards, chat, profile pages, blogs and other services to which you are able to post information and materials. Any Information you post or disclose through these services will become public and may be available to other users and the general public. We urge you to be careful when deciding to disclose any Information on our services.

If you are a resident of California, under 18 and a registered user of our services, you may ask us to remove content or information that you have posted to the services by writing to [webportal_eu@konami.com]. Please note that your request does not ensure complete or comprehensive removal of the content or information, as, for example, some of your content may have been reposted by another user.

Cross-Border Transfer

Konami may from time to time store and process Information collected from you on servers located in countries outside your country of residence, even when we store and process the Information ourselves. In particular, if you reside in the European Economic Area, your Information may be transferred to servers located in a non-EEA country where the Information may be handled in accordance with laws which may differ from those of your country. By using our products and services, you consent to such transfer of your Information.

Access Requests

Please note, however, that if the owner of the Information in question cannot be identified, or if certain other circumstances apply, we may not be able to comply with your request. Furthermore, if you request that Konami delete or stop using Information needed to provide our services, we may no longer be able to provide you with services.

We may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable. Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion. There may also be residual information that will remain within our databases and other records, which will not be removed.

Please note that requests for access to your Information may be subject to a fee to meet our costs.

Your California Privacy Rights

Information Security

Konami seeks to use appropriate and reasonable security measures to protect your Information within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. Retention Period

We will retain your Information for the period necessary to fulfill the purposes outlined in this Policy unless a longer retention period is required or permitted by law.

Children

We do not knowingly collect personal information from children under the age of thirteen although, where our games have a PEGI rating lower than that age, we may allow them to participate in activities available via our website and we do not block our site with an age-gate. We do not, however, allow children under the age of thirteen to participate in activities that require submission of personal information such as message boards or prize competitions. We encourage parents to discuss the reason why we have these rules with their child and to put in place sufficient safeguards on their home networks to prevent their child from circumventing these rules.

Third Parties 

This Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any website or service to which our websites or services link. In addition, we are not responsible for the information collection, use, disclosure or security policies or practices of other organizations, such as Facebook, Apple, Google, Microsoft, RIM or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider or device manufacturer.

Changes to this Policy

From time to time, we may make changes to this Policy. These changes will take effect when published on this website, and your use of our products and services following these changes means that you accept the revised Policy.
